Today in Georgia History:
March 11, 1861 In Montgomery, Ala., the Confederate Congress unanimously adopted the Constitution of the Confederate States of America, which had been principally drafted by Georgians Thomas R.R. Cobb and Robert Toombs. Though largely based on the U.S. Constitution -- there were a number of important differences. The Confederate Constitution also marked the first constitution to provide for the an item veto -- which allow the chief executive to veto specific items with an appropriation act while approving other items. Copies of the new constitution were then forwarded to the eight states that had seceded for ratification.

March 10, 1866 Gov. Charles Jenkins signed legislation making it lawful for married women to maintain bank accounts independent of their husbands so long as the total balance was less than $2,000. This act doubled the amount a wife could maintain separately -- first set at a limit of under $1,000 by an act of 1861.

Today in Georgia History:
March 9, 1818 On the west bank of the Ocmulgee River in what today is Wilcox County, 34 members members of the Telfair County Militia engaged about 60 Creek Indians in the Battle of Breakfast Branch. The battle occurred in an area ceded to Georgia less than two months earlier in the Treaty of the Creek Agency. Four Creeks and five militia members were killed in what proved to be the last battle between Creeks and whites in the area.

Today in Georgia History:
February 24, 1824 Confederate general John Crawford Vaughn was born in Roane City, Tenn. He served in the Mexican War, but was a merchant at the outbreak of the Civil War. In 1861, he recruited a regiment in eastern Tennessee and in June was designated a colonel in the 3rd Tennessee, which fought in the Battle of First Manassas. In Sept. 1862, Vaughn was promoted to brigadier general and given command of his own brigade in Smith's Division during the Vicksburg campaign. He later commanded a brigade in Breckenridge's Division during Jubal Early's raid on Washington D.C. After commanding Confederate forces in East Tennessee, Vaughn escorted Pres. Jefferson Davis during his flight from Richmond into Georgia. After the war, Vaughn served as presiding officer of the Tennessee Senate. He died Sept. 10, 1875 near Thomasville, Ga.

Today in Georgia History:
February 20, 1854 Gov. Johnson signed Georgia's first child labor legislation. The law limited the working of all white persons under age 21 working in cotton, woolen, and other manufacturing establishments to the hours between sunrise and sunset "with the usual and customary time for meals." The penalty for violating the law was a fine up to $200 or imprisonment in jail up to 60 days.

Today in Georgia History:
February 19, 1808 Politician David Emanuel died in Burke County, Georgia. Little is known about his early years, except that he was probably born in Pennsylvania around 1743. At some point, his family moved to Georgia. Emanuel served in the Revolution, both as a soldier and a member of the executive council. After the war, he represented Burke County in the legislature for many years, also serving in Georgia's 1789 and 1795 constitutional conventions. In 1796, Emanuel was appointed to the commission to investigate the infamous Yazoo land fraud. As president of the Georgia Senate, Emanuel became governor on March 3, 1801, when Gov. James Jackson resigned to become a U.S. senator. Emanuel served as governor for just over eight months before retiring from politics. He died at his home in 1808. Four years later the Georgia legislature named a new Georgia county in his honor.

Today in Georgia History:
February 17, 1844 After receiving orders at Charleston, 1st Lt. William Tecumseh Sherman reported for duty at Marietta, Ga. For the next six weeks, Sherman helped take depositions in Georgia and Alabama with respect to personal loses of horses and equipment by militia members from the two states that had fought in the Second Seminole War in Florida. During this assignment, the young 23-year-old officer had a chance to familiarize himself with the area of northwest Georgia that he would visit again 20 years later under vastly different circumstances.

Today in Georgia History:

February 6, 1785 Samuel Elbert was elected governor of Georgia. Born in South Carolina in 1740, Elbert was one of the earliest successful merchants in the colony of Georgia . Owning a considerable amount of land and running a profitable import business, he naturally was interested in British economic policies toward the colonies in the years preceding the American Revolution. Elbert was also a military leader and had risen to the rank of captain in the Georgia militia before war broke out with England. He was a major participant in the group of patriots who regularly met at Tondee's Tavern in Savannah to plan resistance to British policies. By February 1776, Elbert was a lieutenant colonel in the first continental troops assembled in Georgia. Being active in virtually all the Georgia efforts in the Revolutionary War, Elbert was taken prisoner after the Battle of Briar Creek on March 3, 1779. He was exchanged for a British general in 1781, promoted to brigadier general in the Continental Army, and immediately reported to General George Washington for duty. Elbert was on hand for the American victory at Yorktown and was placed in charge of the large deposit of arms and military stores taken in the battle.

After the war, Elbert returned to Savannah and his commercial business (left in disarray by the war), but soon was called upon for political service. In 1783 he acted as treaty commissioner for the Indian talks, and the following year was chosen as a delegate to the Continental Congress, but he declined to serve. In 1785, the legislature elected Elbert as governor of Georgia. Even though his health was beginning to fail, he accepted this position, devoting much of his attention to defense and Creek relations. Also noteworthy during his one-year term as governor was the passage of the act chartering the University of Georgia. After his term as governor, Elbert served one year as sheriff of Chathan County -- but by then his health was failing badly. He died on Nov. 1, 1788 and was buried near his home in Savannah. On Dec. 10, 1790, the Georgia General Assembly named a new county in his honor.

Today in Georgia History:
February 3, 1807 Confederate general Joseph E. Johnston [photo] was born in Virginia. He attended West Point, graduating in 1829 in the same class as Robert E. Lee. In 1861, he resigned from the U.S. Army to offer his services to the Confederacy. In 1864, he commanded the Army of Tennessee during much of Sherman's Atlanta Campaign before being replaced by John Bell Hood. In 1865, Lee named Johnston to again head the Army of Tennessee, with responsibility for Confederate forces in Georgia, Florida, and South Carolina. Johnston's surrender to Sherman on April 26, 1865 resulted in the end of the Civil War for Georgia. He died March 21 1891 in Washington D.C.

January 27, 1785 The Georgia legislature enacted into law Abraham Baldwin's proposed charter for the University of Georgia. In so doing, Georgia became the first state to charter a state university. The act's preamble declared:
"When the minds of the people in general are viciously disposed and unprincipled and their conduct disorderly a free government will be attended with greater confusions and evils more horrid than the wild uncultivated state of nature. It can only be happy where the public principles and opinions are properly directed and their manners regulated. This is an influence beyond the reach of laws and punishments and can be claimed only by religion and education. It should therefore be among the first objects of those who wish well to the national prosperity to encourage and support the principles of religion and morality and early to place the youth under the forming hand of society that by instruction they may be molded to the love of virtue and good order. Sending them abroad to other countries for their education will not answer these purposes; it is too humiliating an acknowledgment of the ignorance or inferiority of our own, and will always be the cause of so great foreign attachments, that upon principles of policy it is inadmissible.
"This country, in times of our common danger and distress, found security in the principle and abilities which wise regulations had before established in the minds of our countrymen. January 26, 1838 Seminole chief Osceola died while in prison at Fort Moultrie near Charleston, S.C. Born in the Creek Nation, Osceola and other Creeks migrated into Florida after the Creek War to join the Seminoles. He was a leader in the Second Seminole War (1835-1842). In 1837, Osceola came under a flag of truce to discuss peace, but on command of Gen. Thomas Jesup, U.S. military authorities arrested Osceola and sent him to prison.

Today in Georgia History:
January 15, 1929 Civil-rights leader and clergyman Martin Luther King, Jr. was born in Atlanta, Georgia. He attended Atlanta's public schools before entering Morehouse College at age fifteen. Upon graduation from Morehouse, King decided to follow his father into the ministry, studying at Crozier Theological Seminary in Pennsylvania before earning his doctorate at Boston University. While in Boston King met and married Coretta Scott. In 1954 he began his ministerial work at the Dexter Avenue Baptist Church in Montgomery, Alabama The following year he was thrust into national prominence as he helped organize and became an important spokesperson for the Montgomery bus boycott. Here his famous rhetoric and philosophy of non-violence were put to the test; attributes which he carried with him throughout his life despite sometime bitter and often violent resistance.

Today in Georgia History:
January 9, 1805 Politician and doctor Noble Wimberly Jones died in Savannah. Born in England around 1723, he and his family were among the original Georgia colonists who arrived with James Oglethorpe in 1733. At age 16, Jones became a cadet and subsequently an officer in Oglethorpe's military force. By the late 1740s, he had learned the practice of medicine from his father and partly from his own experiences. In 1755, after Georgia became a royal colony, Jones was elected to the Commons House of Assembly, where he was elected speaker (1768-69). Soon, however, Jones became part of the Whig movement, and by 1774 was an active patriot. During the American Revolution, he was captured by the British and imprisoned at St. Augustine. After the war, Jones moved to Charleston, but in 1788 returned to Savannah. Here, he practiced medicine the rest of his life, getting involved with politics one more time to preside over Georgia's 1795 constitutional convention. As a measure of his reputation as a doctor, Jones was elected first president of the Georgia Medical Society in 1804.

December 17, 1902 Georgia first state flag (adopted in 1879) was changed to provide that the "coat of arms of the State" be shown on the vertical blue band. Whether an accurate 1902 state flag was ever created is not known, but at an early date -- not later than 1905 -- Georgia's new state flag was being shown with the coat of arms on a white-and-gold shield. And, without statutory authorization, by the 1920s the coat of arms and shield had been replaced with a state seal--which is what commonly is referred to as the pre-1956 state flag.

December 16, 1853 Gov. Herschel Johnson signed an act creating Kinchafoonee County as Georgia's 104th county. Created from portions of Stewart County, Kinchafoonee County was named for the main creek that ran through the area. Criticism of the name, however, led local residents to seek to have the county's name changed. On Feb. 21, 1856, Gov. Johnson signed an act redesignating the county as Webster County. The new name honored former U.S. Secretary of State Daniel Webster, who as a U.S. senator had helped bring about the Compromise of 1850.

Today in Georgia History:
December 3, 1857 Gov. Joseph E. Brown signed legislation creating Dawson County from areas of Gilmer and Lumpkin counties. Dawson, Georgia's 119th county, was named for William C. Dawson. A lawyer, Dawson served as clerk of the Georgia House of Representatives, codified the Georgia statutes in 1828, and and served as a state judge. Subsequently, he was elected to the Georgia Senate, U.S. House, and U.S Senate. Also, in 1836, Dawson raised a volunteer company to fight in the Seminole War.

November 18, 1883 Politician Carl Vinson was born in Baldwin County, Georgia. One of the most influential national legislators of the twentieth century, Vinson's legislative career spanned fifty years and one month--a record of longevity that stood until 1994. Vinson was noted particularly for his dedication to the United States Armed Services. To honor him, the Institute of Government at the University of Georgia was formally named the Carl Vinson Institute of Government in 1983.
